These Terms of Service ("Terms") govern your access to and use of TotalOTD.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Description of Service

TotalOTD.com is a free, informational tool that helps consumers estimate the out-the-door (OTD) cost of purchasing a vehicle. The Site retrieves publicly available vehicle listing data using a Vehicle Identification Number (VIN) you provide, and combines it with estimated state taxes, fees, and user-provided inputs to generate a cost estimate.

TotalOTD.com is not a dealer, lender, or financial institution. We do not sell vehicles, arrange financing, or provide legally binding price quotes.

2. Estimates and Accuracy

ALL ESTIMATES PROVIDED BY TOTALOTD.COM ARE FOR INFORMATIONAL AND BUDGETING PURPOSES ONLY. Specifically:

  • Tax and fee estimates are based on state average rates and publicly available data. Actual taxes and fees are set by your dealer, local government, and applicable law and may differ from our estimates.
  • Vehicle pricing reflects data from third-party listing sources and may not reflect the final negotiated price.
  • Accessory and add-on costs are national averages and will vary by region and provider.
  • Monthly payment estimates are based on user-provided inputs and assumed interest rates. Actual loan terms are determined by your lender.
  • Recall data is sourced from the NHTSA public database and may not reflect all open or recently announced recalls. Always verify recall status directly at nhtsa.gov/recalls before purchasing a vehicle.

We make no representations or warranties regarding the accuracy, completeness, or timeliness of any information displayed on the Site. You should independently verify all material information before making any purchase decision.

3. Not Financial or Legal Advice

Nothing on TotalOTD.com constitutes financial, legal, tax, or professional advice. You should consult qualified professionals before making significant financial decisions, including the purchase of a vehicle.

4. User Responsibilities

By using the Site you agree to:

  • Use the Site only for lawful purposes and in accordance with these Terms.
  • Provide accurate information when entering VINs, ZIP codes, and other inputs.
  • Not attempt to disrupt, hack, or reverse-engineer the Site or its underlying systems.
  • Not use the Site to scrape, harvest, or collect data in an automated manner without our written consent.
  • Not use the Site in any way that could harm, disable, or impair the Site or its servers.

5. Intellectual Property

All content on TotalOTD.com including but not limited to design, layout, logos, text, and code is owned by or licensed to us and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written permission.

Vehicle data retrieved through third-party APIs is subject to those providers' terms of service and intellectual property rights.

6. Third-Party Links and Services

The Site may reference third-party services such as NHTSA, Auto.dev, and Carfax. We are not responsible for the content, accuracy, or privacy practices of third-party sites. Accessing third-party sites is at your own risk.

7. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO YOUR USE OF THE SITE SHALL NOT EXCEED FIFTY DOLLARS ($50.00).

9. Indemnification

You agree to indemnify, defend, and hold harmless TotalOTD.com and its operators, affiliates, and service providers from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or your violation of these Terms.
